Gang rape in train| Allahabad HC issues notice to Ministry of Railways, asks about measures taken to curb such crimes

Synopsis

In September 2016, a woman was raped on a moving train in Uttar Pradesh's Mau district and later thrown out with her ankle chopped

The Allahabad High Court has recently issued notice to the Ministry of Railways, Government of India in a 2016 suo motu Public Interest Litigation (PIL) initiated over an incident of gang rape of a woman in a moving train. 

The bench of Justice Attau Rahman Masoodi and Justice Brij Raj Singh issued the notice while noting that issues of this kind had already been addressed by the high court in a 2013 matter, where the high court had issued certain directions to the Ministry.

Therefore, the bench directed the Ministry to "show cause as to what measures have been taken by it to curb such incidents in the running trains and at the railway stations operated by the Ministry".

In this particular case, a woman was subjected to rape while aboard a moving train and subsequently thrown out of it. Her ankle had also been chopped. The incident had occurred in the Mau district of Uttar Pradesh.

The high court had taken suo motu cognizance of the matter and passed an order on September 19, 2016, to register the case as a PIL. 

During the recent hearing, the division bench was informed by the Additional Government Advocate (AGA) that the victim has been paid a sum of Rs. 2,81,000 towards compensation out of the total compensation of Rs. 3,75,000.

To this, the division bench asked the AGA to obtain instructions as to why the remaining amount has not been paid to the victim before the next date of listing.

The matter will next taken up on March 4, 2024.
