[Nitin Desai Suicide Case] Bombay High Court Refuses Interim Protection To Officials Of Edelweiss; Issues Notice To Respondent

A division bench of the Bombay High Court comprising Justice Nitin W Sambre and Justice RN Laddha on Friday refused interim relief to the officials of the Edelweiss group and has issued notice to the respondent in the Nitin Desai Suicide Case.

The division bench also issued notice to the wife of Nitin Desai who is the complainant in the case. 

Senior Advocate Amit Desai appearing for the Chairman and CEO of the Edelweiss Financial Service Limited sought urgent interim relief from coercive action.

Public Prosecutor Aruna Pai appearing for the state informed the court that the FIR was registered in the last week itself and the investigation was going on. 

The division bench said that the bench will consider interim relief on the next hearing. 

"Wait for a week. We will consider the interim relief on August 18," the bench said.

Other than the officials of the Edelweiss group, Jitendra kothari who was appointed as the interim resolution professional also moved the high court for quashing the FIR.

Desai who worked in Bollywood movies like 'Lagan' and 'Jodha Akbar' was found hanging in his studio at Karjat on August 2. Desai's company had defaulted on Rs. 252 crore of loan repayment after which the insolvency proceedings were initiated under the IBC before the Mumbai Bench of NCLT.
