Notification claiming member shortage in the tribunal not authentic: NCLT clarifies

Synopsis

Yesterday, a notification stating that only urgent matters would be taken up by the tribunal owing to shortage of members was doing rounds in many WhatsApp groups. 

The Registrar-In-Charge of the National Company Law Tribunal (NCLT) New Delhi today issued a communication stating that a notification from August 8, 2022 highlighting shortage of members is not authentic and should be ignored as it was not issued by the NCLT.

On August 8, 2022, a notification, claimed to have been issued by the NCLT, was making rounds in WhatsApp groups. It stated that only urgent matters will be taken up via video conferencing with effect from August 10, 2022 in all NCLT benches due to shortage of members till further orders.

Today, Kamal Sultanpuri, the Registrar-In-Charge, in his communication, clarified that it  no such order was approved by the President, NCLT and the same has not been uploaded on the NCLT website.

"The said Notification is not issued by NCLT and it is not authentic. The so called Notification dated 08.08.2022 has not been approved by President NCLT (Competent Authority). The said Notification to be ignored as not valid. It has not been uploaded on the NCLT website," the communication states. 

The communication further urges all parties to refer to NCLT’s Website i.e. www.nclt.gov.in for authentic information/notifications.
