Palakkad Court Issues Non-Bailable Warrant Against Baba Ramdev, Acharya Balkrishna in Misleading Ads Case

In a case linked to allegedly misleading advertisements, the Judicial First Class Magistrate II, Palakkad, has issued a non-bailable arrest warrant against yoga guru Baba Ramdev, his aide Acharya Balkrishna, and Divya Pharmacy, the marketing arm of Patanjali Ayurved. The order was passed after they failed to appear before the court despite previous directives.

The case, filed by the Drugs Inspector, Palakkad, in October 2024, falls under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. Authorities allege that Patanjali’s advertisements falsely claimed its products could cure high blood pressure and diabetes.

Similar cases have also been registered in Kozhikode and Haridwar, where multiple summons have been issued against the company.

Earlier, the court had issued a bailable warrant, requiring them to appear on February 1. However, their absence prompted the court to escalate its action by issuing a non-bailable warrant.

The next hearing in the case is scheduled for February 15.

In August last year, the Supreme Court closed the contempt case it had initiated against Patanjali for misleading advertisements of medicines. The proceedings were initiated after Patanjali did not abide by its undertaking not to publish advertisements making false claims about its products and targeting modern medicines and vaccinations.

Notably, an Advocate named Yatin Sharma approached the Delhi High Court, in August 2024, claiming that Patanjali Ayurveda and Baba Ramdev were misbranding their products, particularly Divya Dant Manjan (toothpaste), as vegetarian. The advocate contended that the toothpaste while depicting a green dot, however, had the presence of Sepia officinalis (common cuttlefish) which made the product non-vegetarian.
