“Petitioners major, can live in whatever manner they wish to” Delhi High court grants protection to woman against harassment due to voluntary religious conversion

The Delhi High court on Thursday directed SHO, Police Station Gokulpuri to provide protection through beat staff to a woman seeking protection against harassment after she converted to another religion.

The order was passed by the single judge bench of Justice Mukta Gupta on a petition  seeking protection on the ground that she had voluntarily converted to a different religion and that she was being harassed.

The petitioner also sought for her husband for Mr. Mohan Singh who was impleaded as a petitioner in the plea.

Earlier on March 4, 2021, it was pointed out by the Additional Standing Counsel for the State that on verification of the Conversion Certificate and Marriage Certificate annexed with the petition by the petitioner along with the writ petition, the same were found to be forged and fabricated.

Additional Standing Counsel for the State submitted that a status report in this regard had been filed and since the forged documents were filed before the Court, the investigation on the filing of the documents after registration of the FIR has been transferred to PS – Tilak Marg, which has territorial jurisdiction to investigate the offence.

As regards the protection to the petitioners, the Court said that “since both the petitioners are major and can live in whatever manner they wish to, this writ petition is disposed of directing the SHO, Police Station Gokulpuri to provide protection to the petitioners through beat staff and in case of any specific complaint, action thereon be taken in accordance with law. Further the undertaking of the father of the petitioner has already been recorded by this Court vide order dated 4 th March, 2021. The father of the petitioner No.1 will be bound by the statement made by him in respect of the petitioners.”
