Plea By Lawyers Alleging Assault Inside Police Station: Bombay High Court Transfers FIR From Antop Hill To Matunga

Synopsis

The two lawyers alleged that they were detained by the Senior Police Official of the Antop Hill Police Station and were assaulted by the officials.

A division bench of the Bombay High Court comprising Justice Revati Mohite Dere and Justice Gauri Godse recently transferred an FIR from Antop Hill Police Station to Matunga Police Station in a plea filed by two lawyers who alleged that they were assaulted and detained inside the Antop Hill Police Station.

The high court has transferred the FIR to the Assistant Police Commissioner of Matunga Police Station.

Two lawyers had pleaded that despite a written complaint on 20th May 2023, there was no registration of FIR against the officials. 

During the hearing, the court remarked that the court did not want Antop Hill Police officials to do anything further in the case and wanted the case to be transferred to another police station.

Court was also informed that the Antop Hill Police Station had 7 CCTV cameras and the recordings of the day when the lawyers alleged to have been assaulted will be saved and transferred to the Matunga Police Station. This was agreed upon by the DCP after Advocate Uran Warunjikar submitted that the CCTV may be tampered with by the officials. 

The bench agreed with Warunjikar and said that the bench had a previous experience wherein CCTV footage was tampered with by appointing experts.

In its order, the bench has recorded that it expects the ACP of Matunga to investigate the case impartially.

"We expect the ACP, Matunga division to whom the complaint dated 20th May 2023 has been transferred to impartially investigate the same. The DCP (Zone-IV) to supervise the said case," the court said.

Advocate Sandhna Yadav, one of the petitioners, in its plea, stated that she had dialled 100 to lodge a complaint of harassment. She was subsequently called to Antop Hill Police Station and was joined by Advocate Hrishikesh Sharma.

They alleged that Nasir Kulkarni, the senior police inspector spoke to them disrespectfully and when they tried to leave the station, the officer assaulted and detained the two lawyers. 

The 2 lawyers then approached various authorities but no FIR was registered against the official. Therefore, they approached the high court. 

The matter will now be taken up by the division bench on 3rd July.
