Synopsis

The singer has approached the high court for quashing the case while informing the court that the case is pending for the last 17 years.

Singer Mika Singh has approached the Bombay High Court to quash the FIR and chargesheet filed against him on a complaint made by Actor Rakhi Sawant for forcibly kissing her.

Citing that he and Sawant have settled their differences amicably, he submitted that Sawant had sworn on an affidavit, giving her no objection to granting relief mentioned in the petition.

In 2006, Actor Rakhi Sawant filed a molestation case against singer Mika Singh after he allegedly forcibly kissed her at his birthday party, which took place at a restaurant in Mumbai suburbs. Singh was booked for offences under Sections 354 (molestation) and 323 (assault) of the Indian Penal Code.

Singh approached a sessions court for anticipatory bail, which was granted on June 17, 2006. However, the case had been pending for the past 17 years, with charges yet to be framed against Singh.

During the hearing, Sawant's lawyer, advocate Ayush Pasbola, informed the division bench of Justice AS Gadkari and Justice PD Naik that Sawant's affidavit was misplaced by the registry of the High Court and was untraceable. However, he told that she has no objection to quashing the FIR as the two parties have resolved their differences.

Advocate Falguni Brahmabhat, who appeared for Singh, stated that the case has been unresolved for the past 17 years, and Singh and Sawant have buried the hatchet and become friends. She added that the chargesheet had already been filed against Singh, but charges were yet to be framed.

The bench granted Sawant a week's time to file a fresh affidavit, and the next hearing of the plea is scheduled for April 17, 2023.
