The Bombay High Court on Wednesday asked the Maharashtra Government if there was a ban on the celebration of the birth anniversary of Tipu Sultan.
A division bench of the high court comprising Justice Revati Mohite Dere and Justice SG Dige was hearing a petition filed by Pune President of All India-Majlis-e-Ittehabul Muslimeen who wanted to celebrate the birth anniversary of Tipu Sultan on November 26 (Constitution Day) along with celebration of Maulana Abdul Kalam Azad.
He approached the high court seeking permission after the Pune rural police refused to grant permission for the celebration.
The bench told the Pune Police that there was no reason why procession should not be allowed as police can impose restrictions and register offences in case of law and order situation.
Pune Rural Superintendent told the bench last year some incidents led to the registration of offences.
The bench said that the Pune Police can decide the route for the procession. It added that if there was a law and order situation then the police could register an offence.
The high court further said that the law and order situation cannot be a ground for denying permission for the procession.
