[Unnao Rape Case] Delhi HC reduces interim bail duration of Kuldeep Sengar for attending daughter’s marriage

Synopsis

The family of the Unnao rape victim moved the High Court to vacate the order dated January 16, whereby Kuldeep Singh Sengar had been granted interim bail from January 27 to February 10 to attend his daughter's wedding.

The Delhi High Court on Friday reduced the duration of interim bail of Unnao rape case convict and Former Bhartiya Janta Party (BJP) leader Kuldeep Singh Sengar granted for attending his daughter’s marriage.

A bench of Justice Mukta Gupta and Justice Poonam A Bamba modified the earlier order dated January 16, wherein Sengar was granted interim bail from January 27 to February 10 to attend his daughter’s marriage.

During the hearing, Advocate Mehmood Pracha appearing for the victim’s family submitted that Sengar can harm the victim’s family after being released. He contended that there is a threat to their life. Pracha contended that police officials in plain clothes be assigned with Sengar during his entire bail period.

To this, the bench said, “No! We don’t want to do this, We are not going to assign police officers in plain clothes, this will be a more showoff. He is not some VVIP”.

On the contrary, Senior Advocate N. Hariharan appearing for Sengar contended that the threat perception was taken into consideration by the bench while granting interim bail. He also stated that Sengar has to report to the SI Lucknow police daily.

Taking note of submissions, the court noted that Sengar has been released from Tihar Jail today morning, and is on his way to Lucknow to report to the Sub Inspector (SI) at Lucknow police station. It also noted that there is a threat perception to the victim’s family.

The court noted that the two main functions are on January 30 (Tilak ceremony) in Gorakhpur and February 8 (Marriage) in Lucknow. The bench also noted that there is a long gap between the Tilak ceremony and the wedding.

Accordingly, while modifying the earlier order, the division bench allowed Sengar's interim bail from January 27 to 30, thereafter he is to surrender to the police and on February 6 morning he shall be released again to attend his daughter’s marriage and surrender back to police on February 10.

It is to be noted that on January 25, the Unnao Rape victim’s family moved High Court seeking recall of the High Court’s order dated January 16, 2023, wherein the interim bail was granted to Former BJP leader Kuldeep Singh Sengar to attend his daughter’s marriage from January 27 to February 10.

Sengar has been sentenced to life imprisonment for raping a minor girl in the Unnao District of Uttar Pradesh in 2017. He is also convicted and sentenced to 10 years imprisonment in the Unnao rape victim father’s custodial death case.

Sengar’s appeal against the conviction and sentence is pending before the High Court.
