Synopsis

Justice Anu Malhotra of the Delhi High Court has sought a status report from the concerned authorities on a plea seeking directions to initiate the extradition procedure against an absconding man, in a voyeurism and stalking case.

The single-judge bench directed the Ministry of External Affairs (MEA), Delhi Government, and SHO Police Station, Delhi Cantt to file a status report by the next date of hearing i.e. October 18, 2022.

The petitioner also sought directions to social media platforms to take down, remove, block, restrict /disable access to all such videos/pictures of the Petitioner uploaded at fake Instagram and Facebook user accounts.

The plea further sought directions to the Delhi Police to initiate the extradition procedure of the accused person namely Mukesh from the United Arab Emirates as soon as possible by the India-UAE Extraditions Treaty, 1999.

Furthermore, the plea sought directions to the Centre to expeditiously initiate the passport impounding process of Mukesh under section 10 (3) (h) of the Passports Act, 1967, or direct the Delhi Police to notify the Regional Passport Office, New Delhi to initiate the passport impounding procedure.

The petitioner also seeks Delhi Police to invoke the penal provisions of the Information Technology (IT) Act, 2000 against Mukesh, under Sections 354(C), 354(D), 506, 509 of the Indian Penal Code (IPC), 1860.

During the hearing, the counsel for the State stated that an FIR under Sections 354(C), 354(D), 506, 509 of IPC and Section 67 of the IT Act has been registered, and that the charge sheet in the matter is yet to be filed and the accused, Mukesh has been declared a proclaimed offender.

Accordingly, the court listed the matter for October 18, 2022.
