A Special POCSO Court in Dehradun, Uttarakhand has acquitted a 42-year-old man who spent five years in jail on charges of raping his 15-year-old daughter.
The Additional District Judge of the Special Court held that the man had been falsely accused by his daughter because he opposed her skipping school and spending time with a boy. After reviewing the evidence and witnesses' testimonies, the court found that the girl had been influenced by her boyfriend to falsely accuse her father of rape.
In 2019, the Child Welfare Committee (CWC) filed a complaint stating that the girl had reported sexual abuse by her father, with her younger sister corroborating the claim. The case was officially registered on December 25, 2019.
On December 27, the father, who was a laundryman, was arrested and sent to jail.
During the cross-examination, the girl admitted that she was upset with her father due to his disapproval of her relationship and her skipping school. She also confessed that her resentment was fueled by her boyfriend's encouragement to make the false accusations.
It also came to light that during the police investigation, some letters were found written by the girl to her boyfriend.
Furthermore, the court was apprised by the doctor, who performed the girl's medical, that her reports came negative and it could not be confirmed that she had been raped.
Accordingly, court held the allegations false and acuitted the man last week.
