The father-son duo approached the Supreme Court, challenging the Allahabad High Court's decision that denied them bail in the stolen machinery case
The Supreme Court on Monday, February 10, 2025, granted bail to Samajwadi Party leader and former Uttar Pradesh Minister Mohammad Azam Khan, along with his son, Mohammed Abdullah Azam Khan in a case relating to machine theft.
"Taking into considering the period of incarceration undergone by the appellants, and that the chargesheet has already been filed, we are inclined to set aside the impugned order and grant bail to the appellants. Accordingly, the appellants are granted bail, subject to the terms and conditions which are to the satisfaction of the Trial Court, " the court said.
A bench of Justices M.M. Sundresh and Rajesh Bindal passed the order while hearing the plea filed by Azam Khan and his son challenging the decision of the Allahabad High Court that had refused to grant them bail in the instant matter.
Court has directed the father and son to cooperate with the conduct of the trial till its conclusion. It also added that they should not make any attempt to influence or win over the witnesses.
Court also granted the State of Uttar Pradesh liberty to seek the cancellation of bail if the appellants violated any of the conditions imposed.
Background
The matter arose from a criminal case filed against Azam Khan, his son, and several other persons at the Kotwali Police Station in Rampur.
The case was registered under multiple Sections of the Indian Penal Code, including Sections 409, 411, 201, 120B of the Indian Penal Code, 1860 and Sections 2/3 of the Prevention of Damage to Public Property Act, 1984.
According to allegations, it was said that the accused persons had stolen a road-cleaning machine purchased by the Nagar Palika Parishad, Rampur.
After the change in government, an investigation was carried out, which eventually led to the recovery of the same machine from Jauhar University, where Azam Khan served as the chancellor at that time.
On 16 December, the Supreme Court had issued notice to the Uttar Pradesh government, seeking the UP government's response in the plea filed by Azam Khan and his son Abdullah Khan, in which they challenged the order passed by the Allahabad High Court denying them bail in the present case.
