The Delhi High Court has issued notice to Aam Aadmi Party (AAP) MLA, Imran Hussain on a plea seeking action against him for alleged hoarding of Oxygen Cylinders and distribution of the same to people in his constituency. Notice has also been issued to the GNCTD.
The above order was passed by the division bench comprising Justices Vipin Sanghi and Rekha Palli while hearing a batch of pleas relating to Covid management is NCT of Delhi.
The petition was presented by Advocate Amit Tiwari who shared a Facebook post from the official handle of the MLA where pictures were uploaded with a post which said that the MLA was distributing free Oxygen cylinders to people from his office.
The bench however said that looking at the picture does not suggest that the MLA has hoarded the cylinders. The Court further suggested that it may be that he had sourced it from some other state. Hence the source had to be verified before any action be taken against the minister.
Adv Rahul Mehra appearing for GNCTD however assured the Court that strict action will be taken if it is verified that cylinders are being hoarded by any person irrespective of the party to which he belongs. He therefore asked the Court that at first an investigation has to be made to verify the alleged facts.
The Court hence sought reply from the minister and asked him to be present before the Court on Monday.
In the Course of hearing the bench also sought for a complete list of FIRs registered by the Delhi Police from May 2 onwards against persons involved in hoarding oxygen cylinders, oxygen concentrators and essential medicines and said that a contempt action will be issued against them.
Advocate Sanjeev Sagar also shared a TOI news regarding black marketing of oxygen concentrators. He requested the bench to issue contempt notice to Mr. Kalra , a businessman who was found hoarding more than 400 oxygen concentrators. The bench asked the counsel to bring the case on record.
