FAIMA approaches Supreme Court seeking representation of resident doctors in National Task Force

Federation of All India Medical Associations(FAIMA) has moved the Supreme Court of India seeking intervention in the suo moto case being heard by it over the unfortunate incident of rape and murder of a doctor at RG Kar Medical College and Hospital in Kolkata.

Referring to the top court's recent order on establishment of a National Task Force, it has been submitted that there should be adequate representation from the Resident doctors in this force since they are experienced in real time problems on a routine basis and may be in a position to offer a real time solution to these problems.

Court has been told that doctors especially the female doctors are petrified after the horrific incidence and their families are not letting them do the duties especially at night. In this situation, an interim measure has been sought for certain important directions to be implemented with immediate effect.

Thes are: (1) CCTV monitoring of all sensitive areas, including hospital and hostel entrance and exit gates and the corridor areas; (2) Due compliance of the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 including the condition of having a 24 x 7 emergency distress call facility and (3) Ensure that the number of bed to the number of doctor’s ratio is equal for the doctors doing the 36 hours or 48 hours duty.

Similarly, Delhi Medical Association has also filed a plea in the Supreme Court seeking a direction to include safety standards for healthcare professionals at work place to be part of the mandatory criteria for recognition of medical colleges, and hospitals in every state.

United Doctors Front Association (UDFA) has filed an application for intervention in the present matter, seeking to address broader concerns related to the safety and welfare of healthcare workers across India.

In the specific case of R.G. Kar Medical College, the UDFA urges the Supreme Court to demand accountability from all responsible parties, ensure the immediate arrest and prosecution of those involved, and address the systemic issues within the healthcare system that contributed to the tragedy.

Top court took suo motu cognizance of the incident from August 9, 2024 where a young doctor working at a medical college in Kolkata was brutally raped and murdered.

A bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra is currently seized with the matter.

Central Bureau of Investigation (CBI) has begun investigating the alleged rape and murder of a 31-year-old junior doctor at R G Kar Medical College in Kolkata, following the Calcutta High Court's decision to transfer the case to CBI due to the lack of progress in the state police's investigation and suspicion of evidence tampering.
