Karnataka HC declares election of Ex PM Devegowda's grandson, Prajwal Revanna as void

Synopsis

Prajwal, a grandson of ex Prime Minister H D Devegowda, was accused of resorting to corrupt practices by allegedly not disclosing his complete assets in his poll affidavit.

The Karnataka High Court on Friday declared the 2019 election of Prajwal Revanna from Hassan Lok Sabha constituency as void for not disclosing full requisite details in his poll affidavit.

A single bench of Justice K Natarajan pronounced the judgement upon election petition filed by BJP candidate A Manju.

He was declared as the winner having secured 6,76,606 votes on May 23, 2019. Manju came as a first runner up with 5,35,282 votes. 

On December 13, 2021, the Supreme Court had set aside a Karnataka High Court's judgement dismissing an election petition by Manju at the threshold on hyper-technical ground against, Prajwal, who won the seat as a joint candidate of JDS and Congress party from Hassan Lok Sabha constituency.

The court had then set aside the High Court's decision of January 17, 2020. The High Court had opined the petition by Manju was not supported by an affidavit in Form 25, as prescribed under Rule 94A of Conduct of Election Rules, 1961, even though there were allegations of corrupt practices.

"Whether the violation of rules is made out by Prajwal or not would be a matter of trial but certainly not a matter to be shut out at the threshold," the bench had said.

The court had then asked the High Court to examine the matter afresh as more than two and half years had already elapsed since the polls. 

The court also permitted the Manju to file appropriate affidavit within 15 days.

The HC had then termed Manju's plea as "not maintainable” for it was filed without an affidavit and thus incomplete.
