[Maradu Demolition] Appreciating (Retd.) Justice T.B. Radhakrishnan's Efforts In the Enquiry-SC Directs Kerala Government To Pay Rs. 10 Lakhs

While recognising the efforts of (Retd.) Justice Thottahil B. Nair Radhakrishnan, in the enquiry of persons responsible for the illegal construction of the buildings in Maradu, Kochi, the Supreme Court directed Kerala government to pay Rs. 10 Lakhs to Justice Radhakrishnan as a fee for Maradu flats Commission. 'It is a token fee in appreciation of the efforts taken by the former Chief Justice of Kolkata High Court'.

Going by the timeline, the matter caught attention when the Kerala Coastal Zone Management Authority approached the Supreme Court through an SLP against a Kerala Government’s order. The pertinent matter goes back more than 13 years ago, when the Maradu Panchayat issued show cause notices to five builders for constructing buildings against the Coastal Regulation Zone Norms. Eventually, the Top Court ordered Kerala Government to pay an interim compensation to Rs. 25 Lakhs to flat owners of the building each. And the amount to be given as compensation was to be recovered from the builders involved.

The Bench of Justice L Nageswara Rao and Justice BD Gavai appointed (Retd.) Justice Thottahil B. Nair Radhakrishnan, to carry out an enquiry into the matter. The Bench stated, "We request Justice Thattahil B. Nair Radhakrishnan, Chief Justice (Retd.), Calcutta High Court to enquire about the involvement of Builder/Promoter/persons/officials responsible for the illegal construction of the buildings which has already been razed to the ground".

The enquiry revealed that, apart from the builders, the Kerala Government, Maradu Grama Panchayat, Maradu Municipality, officials of the State Government were also responsible. However, Justice Radhakrishnan abstained from commenting on the nature of liability.
