Supreme Court directs pay hike for judicial officers as per pay commission recommendation

Synopsis

The Court was hearing a plea by All India Judges Association for constitution of an All India Judicial Commission to review the service conditions of judges of the subordinate judiciary.

A Supreme Court bench, headed by Chief Justice of India Justice NV Ramana, on Wednesday directed that the enhanced pay scale as per pay commission recommendation for judicial officers from January 1, 2016, shall be implemented.

The bench also directed the Central and state governments to pay arrears in three installments. The schedule is 25% in 3 months, another 25% in the next 3 months, and the balance by June 30, 2023.

Court was hearing a plea by the All India Judges Association for constitution of an All India Judicial Commission to review the service conditions of judges of the subordinate judiciary.

When the matter came up for hearing, K Parameshwar, Amicus Curiae, submitted that the judges were entitled to a revised pay scale in accordance with the recommendations of the Second National Judicial Pay Commission. He submitted that the states denying the same on account of insufficient funds was "unjust".

The bench, on hearing his submissions, held that the revised pay structure should come into effect immediately since judicial officers were not under the pay commissions constituted by the Central and State governments.
