Supreme Court Extends Former Karnataka CM BS Yediyurappa's Interim Relief in graft case

Synopsis

It is alleged that he and his family members accepted crores of rupees as bribes through “shell companies” from a contractor for getting him bids to construct a multi crore housing project of the Bangalore Development Authority.

A Supreme Court bench of Justice D.Y. Chandrachud and Justice Hima Kohli, while hearing a plea by former Karnataka CM B.S. Yediyurappa, extended the interim relief which the Court had granted earlier. The Court issued a notice to the State in furtherance of the same.

Earlier the bench had stayed the investigation by the Lokayukta police into the alleged graft case against the BJP leader. The allegations against Yediyurappa in the matter were, that he and his family members accepted crores of rupees as bribes through “shell companies” from a contractor for getting him bids to construct a multi crore housing project of the Bangalore Development Authority.

Notably, the plea sought by Yediyurappa challenged the Karnataka High Court's order restoring the private complaint, and an investigation into corruption. 

Background: A division bench of Justices DY Chandrachud and Hima Kohli, previously had issued notice to activist TJ Abraham in the matter, and directed a counter affidavit to be filed within four weeks. Abraham had challenged the order of the Special Court refusing sanction to prosecute Yediyurappa and other accused.

It was his contention that the former chief minister misused his influence and office to get the sanction for prosecution denied and got the office of the governor to issue a letter dated June 24, 2021, addressed to the complainant.

The special court had dismissed the case for want of sanction to prosecute Yediyruappa who was the Chief Minister at that time.
