Supreme Court issues notice in plea by woman lawyer alleging arbitrary termination of bar membership, harassment

Notably, the woman lawyer has approached the Supreme Court challenging the High Court’s refusal to transfer to itself or to any other court, the litigation pending before the local court in Kakdwip, wherein she had filed a suit against termination of her membership.

The Supreme Court today issued notice in a plea by a woman lawyer accusing a district bar association in Kakdwip, West Bengal of arbitrarily terminating her membership and harassing her.

Allegedly, the lawyer was not allowed to use the toilet and other facilities in the court premises.

A division bench of Justices Hrishikesh Roy and Pankaj Mithal after hearing the petitioner, suggested that she may read Fali Nariman's book where the senior lawyer talks about maintaining good relations with bar colleagues.

"Vitiated atmosphere in workplace will make your life miserable. There should be effort to not be adamant but have reconciliatory approach...", Justice Roy added.

The female lawyer had filed the instant SLP against the Calcutta High Court order refusing to transfer a suit filed by her in a local court to itself or to another court.

Court has been informed that the situation originated from the bar association asking the woman lawyer, who was undergoing training as a mediator at the West Bengal Judicial Academy, to resign from the post so that she was not the only one receiving a mediator’s fee.

When she refused to resign, a show cause notice was issued against her by the bar association, accusing her of assaulting three men, the court has been further told.
