Supreme Court orders no coercive action against Prof Hausing on comments made over Manipur strife

Synopsis

Hausing recently gave an interview with journalist Karan Thapar on 'The Wire' defaming the Metei community, after which a complaint was made against him for heightening communal enemity.
 

A CJI Chandrachud led bench of the Supreme Court today ordered that no coercive action be taken against Professor Kham Khan Suan Hausing, who has been embroiled in cases after his comments on the Meitei tribe of Manipur.

Senior Advocate Anand Grover appearing for Hausing today. He told the bench comprising Justices Pardiwala and Manoj Misra that Hausing was entangled in two different cases.

"I am expert on this issue and have voiced my opinion..just give me protection like Advocate Deeksha Dwivedi..both these cases are motivated by the interview given to The Wire..I cannot be subjected to torture in Imphal where there is ethnic strife..there are no kukis left there..", Grover told the Court.

CJI after having heard Grover, told him to approach the High Court.

"The petitioner would be at liberty to pursue his relief under Section 438 CrPC. There shall be a stay for two weeks over any coercive action against the petitioner. Two weeks granted to avail remedies under law", Court has ordered.

Supreme Court had on July 28 had refused to urgently hear Hausing's plea challenging summons issued to him by a district court in Imphal over statements against Meiteis.

Hausing, a professor at Hyderabad University, had also sought quashing of the criminal proceedings initiated against him for statements made in an interview which allegedly defamed the Meitei community and fueled communal violence in Manipur.

Notably, Hausing's plea was listed before a CJI DY Chandrachud led bench, but as the bench was unavailable, Senior Advocate Anand Grover had mentioned the plea before Justice SK Kaul led bench.

When Gover expressed some apprehension of a warrant being issue against his client, Justice Kaul assured him that the plea would be heard on Monday, July 31.

Chief Judicial Magistrate, Imphal East, Manipur, had issued summons to Hausing asking him to appear before it on July 28, 2023, in pursuance of the criminal complaint filed against him by Manihar Moirangthem Singh, a member of the Meitei Tribes Union (MTU).

Hausing has relied on Advocate Deeksha Dwivedi's case, who was recently granted interim protection after an FIR was registered against her by the Manipur Police for offences of sedition, conspiracy to wage war, etc.

It is further his case that on account of the situation prevailing in Manipur, there is an apprehension of real and imminent threat to his life if he travels to the state to answer the summons.
