In the impugned order, the Delhi High Court, while dismissing a similar plea, had noted that there is no iota of evidence that establishes that Asthana had ever influenced police officers at Chandigarh by any communication.
The Supreme Court on Tuesday dismissed a plea against a Delhi High Court order rejecting the petition filed by a Chandigarh based dentist seeking to prosecute former Delhi Police commissioner Rakesh Asthana under the Prevention of Corruption Act.
“No interference is called for under Article 136 of the Constitution of India,” a bench of Justices Sudhanshu Dhulia and Prasanna B Varale ordered.
Chandigarh-based dentist Mohit Dhawan had made allegations of extortion against Asthana in his plea.
Instant plea was filed against a Delhi High Court order from February 2021 wherein the plea seeking directions to Central Bureau of Investigation, Central Vigilance Commission, and other bodies to adjudicate the complaints pending against Asthana was dismissed.
Dhawan had filed a complaint 2019 with the CBI director, accusing of extortion, harassment, and fabrication of documents by the police.
