Supreme Court refuses to quash detention order against KSU leader Bushar Jamhar

Synopsis

After hearing the submissions of the petitioner' lawyers, the Bench refused to entertain the plea, where the person was detained under Kerala Anti-Social Activities (Prevention) Act for over 110 days

A Supreme Court Bench comprising CJI U.U. Lalit and Justice Bela M Trivedi, had listed a matter for today, where quashing of the detention order, and thus the release of the detenu, Kerala Students Union (KSU) leader Bushar Jamhar was sought for. The person under scrutiny is a political leader and a law student.

The political leader, also a law student, was detained in June 2022, under Kerala Anti-Social Activities (Prevention) Act (KAAPA).

After hearing the submissions of the petitioner, where the freedom and liberty of the detenue were put in prospect, the Bench refused to entertain the plea. 

The mother of the detenue, submitted that her son has been under detention for over 110 days. And further submitted that a matter seeking revocation of the order is pending for consideration. 

The plea also raised concerns over the 'inordinate delay' and the High Court's silence over the time period in its order. Also the various aspects pertaining to individual's rights and liberties, the delay in granting those and rights of the detainee in a democratic setup were underlined in the petition.
