We will not intervene when movie has already released, court has said

The Supreme Court of India today has refused to allow an SLP filed against a Rajasthan High Court order which stayed the lower court’s order staying the release of Alia Bhatt starrer 'JIGRA'.

A Commercial Court in Jodhpur had stayed the release of movie ‘Jigra’ following a trademark violation plea.

Today, a bench of CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra refused to intervene noting that the movie had already released.

It was petitioner Bhallaram Choudhary's case that he runs online classes with the name ‘Jigar Education’ and that he had also obtained a trademark for the same under The Trade Marks Act, 1999, in September 2023, under Class 41 which deals with education, entertainment and training.

He thus sought stay on release of the movie ‘Jigra’, made by Dharma Productions Private Limited, citing trademark violation.

"What can we do when the movie is already released, hope it is doing well because of this..", CJI Chandrachud said in court today.

Senior Advocate AM Singhvi, appearing for Dharma, submitted that the petitioners coaching institute had no relation with the movie.

"Posters were put up in September. 90 crores of investment made, the petitioner has a certificate for education, mine is motion pictures..", Singhvi further told court.
