Synopsis

The Allahabad High Court recently directed the Joint Commissioner of Police (Law & Order), Police Commissionerate, Lucknow to conduct an "extensive inquiry" into the allegations made in a writ petition. The petition alleged that 50-60 individuals, masquerading as advocates, unlawfully usurped the petitioner's property.

The bench of Justices Rajan Roy and Narendra Kumar Johari emphasized the gravity of the allegations and asked the Joint Commissioner to submit his report in sealed cover.

Based on the result of the inquiry, it shall be open for the police to take such action as may be permissible and required in law without waiting for any order by this Court, court further ordered. 

Court clarified that the direction meant that pendency of the present petition before the court shall not be made a ground for taking any action against the persons, if any, offence had been committed.

While taking action the relief prayed herein shall also be kept in mind, it added. 

Additionally, court ordered that the role of local police shall also be inquired in the context of the allegations made in the petition. "...as to how if any such offence has been committed it was possible such a huge crowd reached the scene, assuming this is correct at this stage," court asserted.

The matter will be next taken up on April 8, 2024.
