A vacation bench of Justice Vibhu Bakhru and Justice Amit Sharma ordered, “The respondent is directed to take the necessary steps for transferring the accused from GTB Hospital to Safdarjung Hospital as expeditiously as possible.”
The division bench was hearing an application filed by Shahzad Ahmed, a convict of the Batla House encounter case, seeking direction to the concerned authorities to transfer him from GTB Hospital to All India Institute of Medical Sciences (AIIMS), New Delhi or Safdarjung Hospital for medical care and treatment.
The counsel for Ahmed contended that he has been admitted to GTB hospital for the past 18 days and has been put on a ventilator. He further stated that Ahmed’s condition is not improving as the hospital does not have a Super Speciality Department in Gastroenterology.
Ahmed’s counsel stated that his recovery will most likely be gradual, as his overall prognosis is uncertain. He added that the diagnosis is of “Acute necrotizing pancreatitis”. Furthermore, he contended that necessary nutrition is also not being provided to Ahmed and his members are also not allowed to meet him.
