Calcutta High Court imposes Rs. 50,000 cost on petitioner for suppressing he is an election candidate

The Calcutta High Court on Tuesday dismissed a petition which alleged that a candidate has obtained fake caste certificate in order to contest in upcoming civic polls of the State. 

The bench of Justice Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj observed that the petitioner, one Tapan Saha, has failed to disclose that he himself is an independent candidate in the upcoming election which amounts to suppression of fact, therefore, dismissing his petition, the bench imposed a cost of Rs. 50, 000. 

The Bench observed that,

"The writ petition is liable to be dismissed on the sole ground that the petitioner is one of the candidate in forthcoming election," and that the suppression of the fact changes the complexion of the matter.

Therefore, it imposed costs of Rs. 50,000 on the petitioner, to be deposited with the legal services authority.
