The Chief Minister made an announcement, which was also published in newspapers on 9th July 2019, that dependents of the deceased in the road accident will receive compensation to the tune of Rs.5 lacs.
The Allahabad High Court recently sought reply of the State Government of Uttar Pradesh as to whether the promise of compensation in a road accident case, as promised by the Chief Minister publically, was announced to be made by the State.
The bench of Justice Attau Rahman Masoodi and Justice Narendra Kumar Johari passed the order on a writ petition moved by on dependent of victims of a road accident who died while traveling in a bus from Lucknow to Delhi.
Post the accident, Chief Minister Yogi Adityanath made an announcement, which was also published in newspapers on 9th July 2019, that dependents of the deceased will receive compensation to the tune of Rs.5 lacs. As many as 29 passengers had died out of whom 13 belonged to district Lucknow.
To claim the same, the petitioners knocked on court's doors.
Court observed that this announcement, except a publication in the newspaper, is not notified in any other official document of the State on the basis of which a right may have accrued to the petitioner. "Yet a promise made to the public at large by Hon'ble the Chief Minister of the State requires consideration," Court held.
Accordingly, Court directed the Standing counsel for the State to obtain necessary instructions as to whether any such compensation was announced to be made by the State towards the loss of life of any such passenger to the dependents or family members of the deceased.
Court posted the matter for further hearing in the week commencing July 18.
