[Cordelia Drugs Cruise Case] Bombay HC to Hear Sameer Wankhede's Plea Seeking Quashing of CBI FIR On Sept 5; Extends Interim Relief Till Sept 7

Synopsis

The CBI had registered an FIR against Wankhede for allegedly trying to extort money from Bollywood Actor Shahrukh Khan when his son Aryan Khan was arrested by Wankhede in the Cordelia drugs cruise bust case

A division bench of the Bombay High Court comprising Justice Nitin Sambre and Justice Rajesh Patil on Monday said that it will hear the plea filed by Former NCB Officer Sameer Wankhede seeking quashing of CBI FIR on September 5.

The high court adjourned the case after Advocate Kuldeep Patil, appearing for CBI informed the court that Solicitor General Tushar Mehta would be appearing on behalf of the CBI.

The high court then adjourned the case and kept it for a hearing on September 5.

The CBI had registered an FIR against Wankhede for allegedly trying to extort money from Bollywood Actor Shahrukh Khan when his son Aryan Khan was arrested by Wankhede in the Cordelia drugs cruise bust case.

Wankhede had approached the high court seeking to quash the FIR registered against him by the CBI. He claimed that he was employed by the Central government, receiving a salary from the finance ministry. He submitted that he was working with NCB on a loan basis. 

CBI claimed that it had obtained prior sanction to prosecute Wankhede whereas Wankhede claimed that the sanction was bad in law as sanction was required to be given by the finance minister and not by the Ministry of Home Affairs.

Earlier the division bench allowed Wankhede to amend his plea to add 3 new additional grounds to his plea seeking quashing of CBI FIR.

Pertinently, a Public Interest Litigation has also been filed before the Bombay High Court seeking an investigation against Bollywood actor Shah Rukh Khan and his son Aryan Khan by the CBI for giving a bribe to former NCB officer Sameer Wankhede.

The PIL seeks interrogation of Shah Rukh Khan, Aryan Khan, and Sameer Wankhede through scientific methods like narco test, polygraph test, etc.
