Designer Gaurav Gupta Approaches Delhi High Court Against Counterfeit Luxury Products

Renowned for his participation in Paris Couture Week and his designs for celebrities such as Beyoncé, Cardi B, and Mindy Kaling, Gaurav Gupta established himself as a leader in the fight against counterfeit luxury products in India. 

Delhi-based fashion designer Gaurav Gupta approached the Delhi High Court against the proliferation of counterfeit luxury products, seeking Rs 2 crore in damages from each counterfeiter and restraining orders to halt further infringements.

Gupta, whose garments typically retail for around Rs 4.5 lakh, highlighted the issue of counterfeiters replicating their signature sculpting techniques, thereby misleading customers.

Advocate Siddharth Bambha, representing Gupta, emphasized that these cases set a significant precedent in protecting the rights of designers. Each case required the expertise of a dedicated team of 4-5 advocates and 2-3 investigators, with the total cost per case amounting to approximately Rs 5-6 lakh, including court fees.

A report highlighted the severe impact of counterfeit goods on the fashion industry, revealing a loss of over $50 billion in potential revenue globally in 2020, with projections reaching $81 billion by 2026. Despite the widespread issue of counterfeit goods in India, most designers have been reluctant to take legal action. Another report further estimated the global trade in fake goods at around $4.5 trillion, with counterfeit luxury merchandise constituting 60% to 70% of that figure, surpassing pharmaceuticals and entertainment products.
