'He introduced himself as Raj though he is Anwar Ali': Allahabad High Court rejects bail plea of man accused of raping minor

The Allahabad High Court on Wednesday rejected the bail plea of a Muslim man accused of raping a minor Hindu girl. Allegedly the man had enticed away the girl making her believe that he was Hindu and tried to convert her to Islam, thereafter.

The bench of Justice Dinesh Kumar Singh passed the order on the plea moved by one Anwar Ali. Allegedly, Ali, though being already married and a practicing Muslim, introduced himself through social media to the girl as 'Raj' and developed a romantic relationship with her. 

As per the order, Ali, thereafter, tried to convert the minor to the Muslim religion and was pressurizing her to perform Nikha with him and when he was trying all these tricks, he was apprehended along with the girl.

Additionally, the order notes that though it was claimed that the minor was 13 years of age at the time of the incident, her medical age was determined as 16 which coincided with her educational testimonials.

The order states, "The accuse-applicant not only betrayed his wife and family, but also breached the trust of an innocent girl, who believed in him and got entangled in his false love."

Therefore, looking at the nature of offence, Ali's marital status, and also the fact that he introduced himself as ‘Raj’ to the girl though he is Anwar Ali, and the girl being minor, Court did not find any ground to enlarge Ali on bail. 

Ali's bail application was accordingly rejected. However, Court directed the Trial Court to make an endeavour to conclude the trial as early as possible, preferably, within a period of one year.
