The Delhi Police in an affidavit before a Delhi Court has informed that on scrutiny of death summaries of all deceased persons in the Jaipur Golden hospital, it is revealed that no death of any patent was caused due to shortage of oxygen.

The affidavit was filed in response to the last opportunity granted to the Delhi Police by Metropolitan Magistrate Vivek Beniwal for filing a detailed status report.

In its affidavit the Delhi Police has stated that "During enquiry the CCTV footage intervening night of 23/24.04.21 the death summaries of deceased persons, who expired on the intervening night of 23/24.4.2021 including Mrs. Tanuja Vidyarthi were obtained from Jaipur Golden Hospital. On scrutiny of death summaries of all deceased persons, it revealed that no death of any patient caused due to shortage of oxygen."

It has further been stated that as allegations are against doctors and medical staffs, the opinion regarding any medical negligence has been sought from Delhi Medical Council and the same is awaited.

In reply to a notice under Section 91 of CrPC seeking death summaries of deceased persons on the intervening night of 23rd and 24th April, 2021, Jaipur Golden Hospital has submitted that the Medical director of Jaipur Golden Hospital  stated that a committee of four doctors was constituted by GNCT, Delhi to ascertain the cause of deaths of patients in the intervening night of April 23-24, 2021 and the committee has opined that the deaths were due to natural reasons and could not be attributed to shortage of oxygen.

It has  further been stated that "After initial scrutiny of patient's death related reasoning, prima facie at that moment, it appeared that in four cases there was drop of oxygen pressure around 9:45 PM on 23/04/2021, which is an unusual occurrence in such numbers. However, it is also a fact that these patients were on ventilator (NIV)". It was only in the above circumstances, that the hospital sought to draw a linkage between the oxygen supply and the increased casualties. Accordingly, the hospital expressed a legitimate concern and raised alarm bells in the wider public interest to ensure and ascertain non-interrupted oxygen supply for other admitted patients."

The case relates to an application seeking directions to the Delhi Police to register an FIR  and also to take into posession documentary, electronic and video graphic evidence in the possession of the Hospital.
