[Malegoan Blast 2008] BJP MP Pragya Thakur Withdraws Discharge Petition From Bombay High Court

BJP MP Pragya Thakur on Thursday withdrew her appeal filed against NIA Court refusing her discharge application in the Malegoan Blast case.

Pragya Thakur, Member of Parliament from the Bharatiya Janta Party, on Thursday withdrew her discharge application from the Bombay High Court. Pragya Thakur had filed a discharge application in a case registered against her in the Malegoan Blast 2008 case.

The appeal was filed against the order of the Special Court refusing to allow the discharge application filed by Pragya Thakur. The present appeal was filed through advocate Prashant Maggu.

The appeal was filed before the Bombay High Court on the grounds that the NIA had not obtained proper sanction from the Central Government to prosecute Pragya Thakur. The court was also hearing a discharge application of the co-accused Prasad Purohit.

During one of the previous hearings, the division bench of Justice AS Gadkari and PD Naik had questioned Purohit as to how the court could hear the discharge application when more than 200 witnesses were cross-examined.

Advocate Prashant in the previous hearing had sought time to take instructions for the withdrawal of the application. Today, the lawyer for Thakur informed the court that the appeal will be withdrawn which was allowed by the court.

Purohit had filed three petitions before the high court which were of similar nature and were overlapping issues. All the petitions were filed on the ground with respect to sanction from the central government.

The bench asked the counsel for Purohit to keep only one petition pending.

The Advocate for Purohit informed the court that NIA was going to bring the sanctioning officer for cross-examination so that petition will be withdrawn.
