Punjab & Haryana High Court seeks ADGP's response on plea by gangsters Sukhpreet Buddha and Amit Dagar alleging deprivation of basic necessities

Synopsis

The plea filed by the duo alleged that the state government wants to kill them by depriving them of the basic necessities which are required for a human being.

The Punjab & Haryana High Court on Wednesday directed the Additional Director General of Police (Prison) to file his response on a plea moved by gangster Sukhpreet Buddha and Amit Dagar of Banbiha Group alleging that they are being kept in complete isolation which violates the apex court judgments.

A bench of Justice Arvind Singh Sangwan, while issuing notice in the matter, asked the ADGP (Prisons), Punjab to file an affidavit with regard to compliance with the directions given in the judgment of the High Court in the case of Viresh Shandilya vs. Union of India.

The plea filed by the duo alleged that the state government wants to kill them by depriving them of the basic necessities which are required for a human being. They claimed that the only reason for depriving the basic amenities is that the police of the State of Punjab want both of them to be mentally de-razed and die their own death and the state is not blamed for their death.

It has been alleged that they are being kept in a high-security ward and are not allowed to come out of the said cell throughout the day except for three hours and they are not allowed to even interact with others.

The plea further submitted that they have been cut off from the entire world which is violative of their right granted under article 21 of the constitution of India.

It has been argued that both of them are not being allowed to avail facilities like newspapers, magazines, and watching television. The plea relied on the judgment in the case of Viresh Shandilya, wherein the court had stated that information and television play crucial parole in bringing prisoners into the mainstream of civilized society and it would be hard and anti-thesis of the international convention if a complete ban of viewing of T.V. is imposed.

The plea has sought direction to the respondents to not commit novel types of torture on the petitioners by breaking them down mentally. Additionally, the plea has further sought direction to provide TV facilities.

Sukhpreet Buddha was extradited from Armenia when he was arrested by Interpol. Amit Dagar's name has cropped up in the murder of International Kabaddi player Sandeep Singh Nangal Ambian.
