Two Bombay High Court judges recuse from hearing ex-Maharashtra Home Minister Anil Deshmukh's plea against his CBI custody

In the Bombay High Court, two judges, on the same day, recused from hearing the plea moved by former Maharashtra Home Minster Anil Deshmukh against the orders of the Special Court allowing his custody to the Central Bureau of Investigation in a corruption case.

Initially, Justice Revati Mohite Dere recused herself from hearing the matter, however, later when the matter was mentioned before Justice Prakash Deu Naik, he also recused himself.

The bench was hearing the plea filed against the order passed by the special Court allowing custody of Deshmukh to the CBI in relation to corruption charges.

An FIR was registered against Deshmukh and some unidentified persons on April 24, 2021, on charges of corruption and misconduct following a preliminary inquiry which the Central Bureau of Investigation (CBI) had conducted in compliance with the high court's order.

Allowing the CBI to conduct the preliminary enquiry, Court had remarked, "We agree with Nankani and Jha that it is an unprecedented case before the court... Deshmukh is Home Minister who leads the police... There has to be an independent enquiry... But CBI need not register FIR immediately or take up Patil's complaint."

Also, The Bombay High Court had refused to quash the FIR lodged by the CBI against Deshmukh. Court had then observed, "The agency can legitimately probe the reinstatement of Waze after 15 years only to the extent that it links with the probe in the Rs 100 crore corruption case against Deshmukh."
