After requesting removal of Calcutta High Court's Acting Chief Justice, TMC workers have sought the removal of Solicitor General Tushar Mehta.
TMC workers, Derek O'Brien, Sukhendu Sekhar Ray and Mahua Moitra claim that Solicitor General Tushar Mehta and BJPs' Suvendhu Adhikari had a meeting recently with the intention of influencing the outcome of matters in which Adhikari is an accused. The workers have written a letter to Prime Minister Narendra Modi seeking removal of the Learned SG.
The letter states that tweets have also been circulated on social media by prominent personalities questioning such a meeting between Adhikari and Mr. Mehta, which the letter adds "Curiously" took place subsequent to a meeting of Suvendhu Adhikari with the Hon'ble home Minister, Mr. Amit Shah.
"We have reasons to believe that such a meeting has been organised to influence the outcome of matters where Suvendhu Adhikari is an accused, using the high offices of the Learned SG. We state that the act of the LD. SG not only reeks of impropriety but also raises the question of integrity and taints the post occupied by the Solicitor General," the TMC Workers state in their letter.
Recently, Ashok Kumar Deb, Trinamool Congress MLA & had written to Chief Justice NV Ramana, seeking removal of the current acting Chief Justice of Calcutta High Court, Justice Rajesh Bindal.
While the letter was on the letterhead of the “Bar Council of West Bengal” and was undersigned by the TMC MLA, the body of the letter stated that the West Bengal Bar Association is "compelled" to write the instant letter under "urgent and dire circumstance".
The letter stated that any endeavour that may seek to endanger the sanctity of this Hon'ble Court will destroy the sacred fabric of this institution.
The letter touched had upon the alleged "disgruntled past" of Justice Bindal, stating that he was earlier appointed as the Acting CJ of Jammu & Kashmir high Court on November 19, 2018 and it was due to his behaviour and attitude that the Jammu & Kashmir High Bar Association had resolved to boycott the Court on or around September 16, 2019. "Within a year, the lawyers at Jammu & Kashmir were fed up of his Lordships antics," says the letter.
The letter which was written to CJI NV Ramana rested on similar contentions that have been raised in the current letter seeking removal of the SG, i.e., basis alleged pictures of Justice Bindal visiting the Hon'ble governors home which were widely published, says the letter. "Videos on social media posts give the impression that Hon'ble Justice Bindra is a BJP man through and through".
It is pertinent to note that the Chief Minister of West Bengal, Mamata Banerjee had sought recusal of Justice Kausik Chanda from hearing her plea challenging Suvendhu Adhikari's election from Nandigram.
Two Supreme Court judges, Justices Indira Banerjee & Justice Aniruddha Bose also recused themselves from hearing plea's concerning West Bengal Violence as well as the Narada Scam case respectively.
