Delhi Police Arrests Navneet Kalra Accused Of Hoarding And Black Marketing Of Oxygen Concentrators In The National Capital

In a curious turn of events, Delhi Police has arrested Navneet Kalra, prime accused in black marketing and hoarding of Oxygen Concentrators in the National Capital.

Earlier, A Single Judge Bench of Justice Subramonium Prasad had denied any interim relief to the accused and had listed the matter for hearing on Tuesday.

Learned ASG, SV Raju, on a previous occasion, had submitted that, “If we grant him Anticipatory Bail, Crucial evidence will go missing. What is also required is… society must also be taken with balance, as far as societal interest must be considered. Wrong message will be sent to all other Black Marketeers.

Defending Kalra, Senior Counsel Mr. Singhvi submitted, “Criminality cannot flow in ambiguity. Mi Lord has to be shown of the violation of a Statute Prima Facie. The Act clarifies the scope of Section 2 juxtaposed with Section 3. It doesn’t matter if you are put into a schedule or not. ‘Essential’ is meaningless unless there is an order mandating MRP, because Section 7 Essential Commodity Act operates only on an Order.”

On May 13, 2021, ASJ Shri Sandeep Garg, Saket Court, rejected the anticipatory bail application of Navneet Kalra against which the petitioner approached the Delhi High Court.

Senior Counsel, Vikas Pahwa represented the Petitioner before the Learned ASJ.
