Former Maharashtra Home Minister Anil Deshmukh document leak case: Delhi High Court seeks CBI's response in bail plea of SI Abhishek Tiwari

The Delhi High Court today issued notice in a plea filed by Abhishek Tiwari, Sub Inspector, Central Bureau of Investigation (CBI) for allegedly disclosing case sensitive and confidential documents for purposes of subverting investigation of the earlier case involving former Maharashtra Home Minister Anil Deshmukh in lieu of undue advantage and illegal gratification.

The single judge bench of Justice Yogesh Khanna has sought response from CBI on the matter.

The petition filed through Advocates Meenesh Dubey and Abdhesh Chaudhary submits that “the petitioner is a victim of circumstances in as much as he has been made scapegoat & victimized by his senior in the CBI in order to put undue pressure for reason best known to them whereas in the facts and circumstances of the case, the petitioner is not involved in the alleged offence as put forth in the present crime case”.

On Aug 31, 2021 an FIR was filed against Tiwari along with co-accused and lawyer Anand Daga, for offences under Sections 120B, 409 of IPC R/w Sec 7 & 8 of Prevention of Corruption Act after the alleged leakage to the media of a report that was part of a preliminary inquiry conducted by CBI, on Aug 29.

The report said that the agency after investigation had concluded that “no cognizable offence has been committed by Anil Deshmukh”.

The CBI has alleged that after an internal inquiry was conducted, it was revealed that Deshmukh’s legal team tried to bribe some officials in the lower ranks to extract the information of the preliminary inquiry. CBI has said that it will take strict action against the leak.

Tiwari had been in illegal detention since Au 30, 2021 but was arrested only on Sep 1, 2021 after registration of FIR on Aug 31, 2021. Thereafter on Sep 2, he  was produced before the Special Judge, CBI and was remanded to police custody for 2 days. On Sep 3, he was served with the order of termination while still in custody.

On Sep 8, Special CBI Judge Vimal Kumar Yadav of Rouse Avenue Court dismissed Daga's and CBI’s Sub Inspector Abhishek Tiwari's bail applications.

Thereafter, the High Court issued notice to CBI on Daga's bail plea, in connection with the same case.
