Namaz in open spaces: Plea in Supreme Court alleges Haryana officials inaction in curbing communal & violent tendencies

Mohammed Adeeb, a former Rajya Sabha member, has moved Supreme Court alleging inaction by Haryana's top officials in curbing communal and violent tendencies. 

The plea comes in light of the recent row over Friday prayers being offered in open spaces at Gurugram. Adeeb has stated that in being unable to curb elements who are protesting at the sites, the Haryana officials stand in contempt of the Supreme Court's directions in Tehseen Poonawalla Vs. Union of India.

He states that in light of the the Poonawalla judgment, certain directions and measures are required to be taken by the authorities to "curb the communal and violent tendencies that result in perpetration of hate crimes".

Chief Secretary of Haryana Sanjeev Kaushal and DGP of Police PK Agarwal have been marked responsible for their inaction in curbing the alleged communal tendencies in the plea.

Plea states that the muslim community offers prayers in congregation on Friday and due to the footfall in Gurugram during the day time, Jumaah Namaz is offered at various locations pre-approved by local authorities and that this is not encroachment of any manner.

"It is worthwhile to note that this measure is necessitated due to lack of administrative foresight in town planning and non- availability of spaces for Namaz.... Muslims of Gurugram have been performing Friday prayers peacefully and without causing any disturbances in open lands due to the lack of allotment of any places for such performance of namaz by the Municipal Authorities... open locations used for the limited purpose of performing Namaz is not in any manner of encroachment but rather is conducted only after approval from the relevant government authorities"

Plea claims that despite complaints, no action was taken by the officials and persons continued to create hurdles in the performance of prayers by the local Muslims, Namaz had to be either stopped completely by the community or the location had to be changed in fear of and in order to avoid, any untoward incidents taking place.
