State of UP not going soft on accused unlike concerns that were raised: Harish Salve at Lakhimpur hearing

Senior Advocate Harish Salve, who appeared for the State of UP in the Lakhimpur Kheri incident issue informed the court that the State was not going soft on the accused unlike concerns that were raised. Salve further told the bench consisting of the Chief Justice of India and Justices Surya Kant and Hima Kohli that all suspects are arrested and they are in jail.

Salve further informed the court that as on today 10 accused are in the jail.
Last week, Court had stated to the counsel appearing for the State of UP that he accused should be treated the way other accused are being treated.
The CJI further said "What is the message we are sending? If a case of 302 has been registered the police should arrest him!" referring to the fact that Asish Mishra had then not been arrested.

The Uttar Pradesh Police had on October 9, arrested Ashish Mishra and 2 others in connection with the Lakhimpur Kheri violence case.
He has been accused of running his car over protesting farmers and killing them. It is to be noted that he is the son of Member of Parliament and Union Mister of State for Home Affairs, Ajay Mishra.

He was served a notice under Section 160 of Code of Criminal Procedure,1973, and had appeared before the Crime Branch Office at Lakhimpur Kheri today at 11 AM. Ashish had been named in a First Information Report (FIR) for murder, criminal conspiracy in connection with the killings at Lakhimpur Kheri. According to some media reports, he has provided some evidence to prove he was not in the car that ran over protesting farmers at Lakhimpur Kheri.

It is to be further noted that the Uttar Pradesh police on October 11, obtained a 3 day custody of Ashish Mishra, for his alleged role in the Lakhimpur Kheri violence. The court of chief judicial magistrate Chinta Ram allowed UP police the custody of Ashish Mishra between October 12 and October 15.
