Supreme Court extends stay on execution of non-bailable warrant issued against Randeep Surjewala till January 8, 2024

Synopsis

On the last date of hearing, Supreme Court was told that the trial court had also recently dismissed Surjewala's application seeking some origin records relating to the crime

On Friday, a Supreme court bench of CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra extended the stay granted by it on the execution of a non-bailable warrant issued against Congress leader Randeep Surjewala in a 2000 case.

Senior Advocate AM Singhvi, appearing for Surjewala, told the bench that summons for tomorrow were issued.

Hearing this the CJI said, "Proceedings shall remain stayed. List on January 8, 2024."

Five weeks back, the Supreme Court had stayed the execution of warrant issued against Surjewala while granting him liberty to move the trial court for cancellation of the warrant within 4 weeks.

Earlier, Varanasi court's special judge (MP-MLA) Avanish Gautam had issued non-bailable warrant against the national spokesperson of Congress, ordering him to be produced before the court on November 21. 

Singhvi had mentioned Surjewala's plea before the supreme court saying that the incident in question has occurred 22 years back.

When CJI Chandrachud questioned Singhvi about approaching the Allahabad High Court first, he had said, "I did, but no orders were passed..FIR is from 2000 over a political agitation did in 2000..he is summoned in August 2022..".

Singhvi had then pressed for some breathing time for his client.

"A grievance is made that High Court did not entertain petition seeking quashing of NBW. Petitioner is granted liberty to move trial court for cancellation of NBW within 4 weeks..the warrant shall not be executed in the meantime for a period of 5 weeks", the bench had ordered accordingly.
