Synopsis

As polling for panchayat elections began at 8 AM today in the state, a mentioning was made before the Chief Justice's court seeking a stay on them

The Supreme Court today refused to stay the ongoing gram panchayat election in the state of Punjab. A Chief Justice of India led bench was informed today that voting was already underway.

"There will be chaos if courts start staying elections on polling day", a bench also comprising Justices JB Pardiwala and Manoj Misra told the petitioners before it.

A mentioning was made before the top court challenging the Punjab and Haryana High Court's decision from yesterday allowing panchayat polls in the state. High Court has dismissed around 800 petitions seeking cancellation of panchayat elections without hearing the aggrieved parties, the bench was told.

"If polling has started today, how can we intervene at this stage? Probably the high court realised the gravity of it and vacated the stay on the elections", the CJI added.

The petitions before the High Court alleged irregularities in the nomination process of the elections. It was the Punjab government's case that the petitioners were required to instead file election petitions.

As the top court has agreed to hear the appeals before it, the bench refused any interim stay. Tomorrow a stay on parliamentary elections would be sought, it said.
