"You Are A Dangerous Man": CJI SA Bobde In Prime Accused Madani's Bail Modification Plea In Bangalore Blast Case

The Supreme Court led bench comprising Hon’ble Chief Justice SA Bobde, Justice AS Bopanna & Justice V Ramasubramanian will hear the plea filed for modifying the conditions of bail imposed by the Court on by prime accused Abdul Nazir Muadany in the 2008 Bangalore blast case next week. 

 “You are a dangerous Man Mr. Counsel and the Bench discussed the earlier order passed in the matter. We will keep it for next week.”, CJI remarked.  

The Bench was hearing an application filed by Advocate Radhya Shyam Jeena on behalf of Abdul Maudany, Kerala based PDP Chairman to seek to modify his bail application to the extent that he be permitted to travel to his hometown in Kerala till the pendency of trial. 

The application was filed on the ground that the undertaking based on which bail conditions survived lapsed & that even after 6 years, the trial has not been concluded. He further contended that he suffered from multiple ailments & that his health condition was worsening since he was denied proper & timely treatment as a result of which he lost total vision in his right eye. 

The Apex Court comprising Justice J Chelameshwar & Justice AK Sikri vide order dated July 11, 2014 granted bail to Muadany on the ground that he was an under trial prisoner since last four years & was suffering from various health disorders. The Bench thereafter released Muadany by imposing the following conditions: 

(i) that the petitioner shall furnish two sureties for an amount of Rs. 1 lakh each;

(ii) that the petitioner shall not leave the city of Bangalore;

(iii) the petitioner shall furnish, before his enlargement on bail, the address where he is going to stay in Bangalore;

(iv) the State of Karnataka is at liberty to take such steps as to prevent the petitioner from escaping the jurisdiction or in any way communicating with anyone of the witnesses, in the case. 

Muadany was listed as the 31st accused in an additional charge sheet which was filed by the police after suspected T Nazir, as an operative of Lashkar-e-Taiba confessed Muadany’s linking to the Bangalore blasts in which one person was dead & 20 others were injured & was thereafter arrested in 2010.
