Key Judicial Developments of the Week In India.
1. Sambhal Violence Case
The Supreme Court quashed the preventive detention of Mulla Afroz in the Sambhal violence case, holding that the material relied upon by the authorities did not justify preventive detention. Court also imposed ₹10 lakh costs on the Uttar Pradesh government and directed Afroz’s release unless required in another case.

2. 0.4% MDR On UPI Payments
The Supreme Court declined to stay the Centre’s decision to impose a 0.4% Merchant Discount Rate on specified UPI merchant transactions above ₹2,000. Court sought responses from the Centre, RBI and NPCI on the challenge to the new framework.

3. Three-Language Policy
The Supreme Court directed the CBSE to exempt Class 6 students from the three-language requirement, in a matter concerning implementation of the language policy. The direction came amid the wider debate over language requirements in school education and their implementation by CBSE-affiliated institutions.

4. Firecracker Ban
The Supreme Court declined to impose a complete ban on firecrackers and considered permitting their use during specified time windows around Diwali. The proceedings continued against the backdrop of concerns over air pollution and the enforcement of existing restrictions on fireworks.

5. Umar Khalid, Sharjeel Imam Bail Pleas
The Delhi High Court rejected the bail pleas of Umar Khalid and Sharjeel Imam in the larger conspiracy case arising from the 2020 Delhi riots. Court said it was bound by the Supreme Court’s earlier directions and could not modify the conditions governing their fresh bail pleas.

6. PM Modi Degree Row
The Gujarat High Court dismissed Arvind Kejriwal’s appeal and upheld the ₹25,000 costs imposed in the case seeking disclosure of Prime Minister Narendra Modi’s educational records. Court held that PM Modi’s educational qualifications are personal information and that there was no public interest in disclosure when his qualifications have no bearing on his election.
7. Senior Citizen’s Property Rights
The Delhi High Court upheld the power of authorities to evict a daughter-in-law from a senior citizen’s property under the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009. Court upheld Rule 22(3)(1)(i) and Rule 22(3)(1)(iv) of the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009.

8. Twisha Sharma Case
The Madhya Pradesh High Court allowed retired judge Giribala Singh to amend her bail plea after the CBI dropped the dowry death charge against her. The CBI instead charged Singh with abetment of suicide under Section 108 of the Bharatiya Nyaya Sanhita in connection with Twisha Sharma’s death.

9. 24x7 CCTV Surveillance At Police Stations
The Allahabad High Court directed that CCTV cameras installed at police stations must remain functional round the clock and laid down safeguards for instances of malfunction. Court said absence of CCTV footage or proper records in cases alleging detention could lead to a presumption of illegal detention.

10. Suo Motu Action After Class 2 Student’s Death Amid Loud DJ Music
The Allahabad High Court (Lucknow Bench) took suo motu cognizance after a Class 2 student collapsed and died allegedly amid loud DJ music during a procession near her school. Court sought answers on enforcement of noise pollution rules and initiated fresh proceedings on the widespread use of loudspeakers and sound systems.

11. Meerut ‘Blue Drum’ Murder
A Meerut court convicted Muskan Rastogi and her alleged lover Sahil Shukla for murdering Saurabh Rajput and concealing his dismembered body in a cement-filled blue drum. The case involved more than 100 hearings and 22 prosecution witnesses, with sentencing scheduled for October 14.
