Plea In Varanasi Court seeks transfer of suit pertaining to possession of Gyanvapi From FTC To District Judge

Synopsis

The Fast Track Court has reserved the judgment on the maintainability of the suit for handing over the possession of the Gyanvapi Mosque premises to Lord Adi Visheshwar Virajman and is likely to pronounce the order tomorrow.
 

A plea has been moved before the Varanasi Court seeking transfer of the suit filed seeking possession of the Gyanvapi Mosque premises to Lord Adi Visheshwar Virajman to the court of district judge. 

Interestingly, the plea was filed on November 15, just two days before when the Fast Track Court is likely to pronounce its order over the maintainability of the concerned suit.

The plea, filed by Laxmi Devi, Sita Sahu, Manju Vyas, and Rekha Pathak, who are also the four of the five plaintiffs in the suit seeking permission to worship Hindu deities inside Gyanvapi throughout the year, stated that both the suits should be consolidated as both are similar in nature.

"...it would be in the public interest if the suits of similar nature raising the identical issues of facts and law are tried together by the same court to prevent the multifariousness of proceedings and, contradictions in judgments/orders on crucial issues and to maintain the appellate/revisional equally for all. In case the suits are tried together, the public time, money and avoidable difficulties of legal nature may not arise," the transfer application read. 

The transfer application was moved under Section 24 (1) (b) of the Civil Procedure Code seeking transfer of the suit filed by Lord Vishweshwar Virajman (Swayambhu) through his next-friend Kiran Singh, International general secretary of Vishwa Vedic Sanatan Sangh.

Along with the handover of the possession of the Gyanvapi complex, the suit filed by Singh also sought permission to worship the 'Shivalinga' reportedly found inside the Gyanvapi on May 16.

Hearing the transfer application on Wednesday, the District Judge in-charge ordered that the transfer application be registered as a miscellaneous case and the details of the concerned case be forwarded from FTC/Civil Judge (Senior Division) to the Court of District Judge, Varanasi.

The Fast Track Court of Civil judge (senior division) Mahendra Kumar Pandey reserved the judgment on the maintainability of the concerned suit on October 27 and the order is likely to be pronounced on November 17.
