The plea has been filed by Masjid and Madarsa Ayesha against the illegal construction raised by the residents in the area of Sunder Nagri, Nand Nagri, Delhi.
The Delhi High Court on Monday directed the Government of the National Capital Territory of Delhi to provide an adequate Police Force to the authorities to proceed with the demolition at the Sunder Nagri, Nand Nagri, Delhi wherein there is rampant illegal construction being raised by the residents in the area.
A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad has directed the respondents to provide all necessary things including the Police force for the purpose of demolition. The Court has directed the Delhi Police Commissioner to ensure that the Police force is provided.
The plea has been filed by Masjid and Madarsa Ayesha with regard to the rampant illegal construction raised by the residents in the area of Sunder Nagri, Nand Nagri, Delhi, in several properties. It has been alleged that even demolition orders have been passed against the said illegal construction in the year 2020, however, the same has not been implemented to date.
Today, the counsel appearing for the petitioner informed the bench that the Court had directed the demolition of all the illegal constructions and the order has not been complied with.
Additionally, the counsel appearing for the Authority informed the bench that the Police force has not been provided and the demolition work cannot be initiated as it is a sensitive area.
However, the counsel appearing for the GNCTD submitted that an adequate Police force will be provided.
The bench, while directing the Delhi Police Commissioner to ensure that an adequate police force is provided, listed the matter for further hearing in September.
The Court has further directed all the respondents to file Status Report within 2 weeks.
Earlier, the High Court had directed the respondents to take steps for the removal of any illegal construction in Sunder Nagri, Nand Nagri, Delhi, and to file a status report with regard to the action taken before the next date of hearing.
The Court had also directed the respondents to ensure that no further illegal construction is raised in the said area.
