BJP leader Suvendu Adhikari moved the Supreme Court seeking transfer of Mamata Banerjee's case against his election from Nandigram to any other high court other than the Calcutta High Court.
On Friday, BJP leader Suvendu Adhikari withdrew his petition filed before the Supreme Court seeking transfer of Mamata Banerjee's petition challenging his election from Nandigram to be transferred to any other high court other than the Calcutta High Court.
A division bench of Justice DY Chandrachud and Justice Hima Kohli said, "Let the High Court having jurisdiction over the issue try the matter".
In pursuance of the same, Senior Advocate Harish Salve appearing for Adhikari withdrew the plea stating that Adhikari may seek relief before the judge of the high court presiding over the trial of the election petition if any need arises regarding the facilitation of orderly conduct of the election petition.
Adhikari's plea had been filed in view of the developments in Mamta Banerjee's plea before Calcutta High Court. The high court issued notice in the election petition which challenges the win of the BJP Leader from Nandigram.
A single Judge bench of the high court comprising Justice Shampa Sarkar took up the plea after Justice Kausik Chanda had recused himself from hearing it basis a petition filed by Banerjee seeking his recusal & also directed that the copy of the order be served upon the Election Commission of India.
Before the high court, Senior Advocate Soumendu Mukherjee appeared for Mamata Banerjee who was also present during the hearing.
Moreover, While recusing himself from the matter, Justice Chanda had observed that Banerjee had indulged in a smear campaign of vilification and had imposed a fine of Rs. 5 lacs on the Chief Minister.
