Synopsis

A single judge bench of Justice C.V Bhadang, has reserved its order in an appeal filed by Salman Khan, before the Bombay High Court seeking interim relief restraining his neighbor, Ketan Kakkad from posting and circulating any defamatory statement against Khan on social media.

Salman Khan had filed a defamation suit against Ketan Kakkad in the City Civil Court alleging that the defendants had made false, disparaging, and defamatory allegations in videos, posts, and tweets causing harm and loss to Khan, his family members, and his business ventures.

The subordinate court had denied actor Salman Khan interim relief in a defamation suit that he had filed against Non-resident Indian (NRI) Ketan Kakkad, his neighbor, for allegedly making derogatory remarks against him and his family.

Judge A.H Laddhad noted,

“I am of the view that, as the plaintiff failed to explain innuendo how it relates to him and the defendant raised the plea of justification which is  prima facie  supported by documentary evidence, therefore in view of judgment in case of  Dr. Jaswant Trivedi, I am not inclined to grant an injunction to the plaintiff.”

Actor Salman Khan then moved the Bombay High Court against the interlocutory order of the city civil court seeking an injunction against the respondent till the disposal of the case.

The counsel for Salman Khan requested the High Court that, to restrain the defendants from uploading any defamatory content on social media, while the matter is pending for disposal before the subordinate Court. He also argued that the defamatory content was uploaded to malign the image of Khan.

Counsel representing Kakkad argued, that he had only uploaded content with regard to the land to which he was denied access to and that there was nothing defamatory against Khan.

The High Court reserved its order, on Tuesday, after both the counsels concluded their arguments
