Delhi High Court allows habeas corpus plea of woman whose son was illegally detained at behest of wife and brothers in "Nasha Mukti Kendra"

The Delhi High Court has ordered for the production of a man allegedly detained without medical cause and illegally, against his will at a Nasha Mukti Kendra operated by the Deepti Foundation Trust in Village Sarah (NIT), Faridabad at the behest of wife and her brothers.

Hearing the habeas corpus petition filed by the man's parents under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure (CrPC) the division bench of Justices Anup Jairam Bhambhani and Siddharth Mridul directed for the man to be produced before court by the Delhi Police. 

The petition prayed for issuance of a writ of habeas corpus or any order or direction in the nature of habeas corpus, directing all the
respondents to produce the said son of petitioner namely Virender before the Delhi High Court.

On being produced the man, Virender Kumar, stated that he would like to return to his home and reside there with his mother.

Considering the serious allegations made on behalf of Kumar before the court, the bench also directed the concerned Police Station to record his complaint/statement and thereafter take necessary action in accordance with law and directed Delhi Police to ensure adequate safety and security to the petitioners and their son against the wife and brothers.
