[Defamation Case] Delhi HC Issues Notice to Union Minister Gajendra Shekhawat in Ashok Gehlot's Appeal Against Summons

The Delhi High Court has issued notice to Union Minister Gajendra Singh Shekhawat in an appeal filed by former Rajasthan Chief Minister Ashok Gehlot challenging his summoning in a criminal defamation complaint.

Justice Swarana Kanta Sharma directed Shekhawat to submit his response to the petition within two weeks and scheduled the appeal for further hearing on March 6.

The court also instructed the trial court to adjourn the ongoing case to a date later than the one fixed for the high court hearing.

Ashok Gehlot has challenged a Sessions Court's decision from last year that dismissed his appeal against the summons in the defamation complaint filed by Gajendra Singh Shekhawat.

The Sessions Court, in its ruling, found no factual mistake, illegality, or impropriety in the summons issued by an additional chief metropolitan magistrate.

The criminal defamation complaint by Shekhawat alleged that Gehlot, through press conferences, media reports, and social media posts, publicly defamed him by linking him to the purported Sanjivani Credit Co-operative Society scam in Rajasthan, involving an estimated Rs. 900 crore and defrauding thousands of investors with promises of unusually high returns.

The magisterial court had earlier stated that Gehlot prima facie made defamatory imputations against Shekhawat, knowing the implications and intending to harm his reputation. The trial court allowed Gehlot to appear before a metropolitan magistrate through videoconferencing but refused to stay the proceedings.
