Delhi High Court defers hearing in bail plea filed by Kashmiri separatist leader Naval Kishore Kapoor in terror funding case

Synopsis

The bail application has been filed by Kashmiri separatist leader, Kapoor in the case over his alleged involvement in the terror funding case.

The Delhi High Court on Wednesday deferred hearing in a bail application filed by Kashmiri separatist leader Naval Kishore Kapoor, accused in a terror funding case.

The matter has been adjourned to January 31, 2023, due to the unavailability of the bench comprising Justice Siddharth Mridul and Justice Talwant Singh.

The bail application has been filed by Kapoor in connection with Jammu & Kashmir terror funding and secessionist activities case. Recently, in this case, Yasin Malik has been awarded life imprisonment. Kapoor has been charged for offences under the provisions of the Unlawful Activities (Prevention) Act.

Earlier, the Court had framed charges against Kashmiri separatist leaders along with Kapoor who are accused in the case, including Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Md Yusuf Shah, Aftab Ahmad Shah, Altaf Ahmad Shah, Nayeem Khan, Md Akbar Khanday, Raja Mehrajuddin Kalwal, Bashir Ahmad Bhat, Zahoor Ahmad Shah Watali, Shabir Ahmad Shah, and Abdul Rashid Sheikh.

It may be noted, Malik- the flag bearer of JKLF on May 10, had pleaded guilty before the NIA court to all charges under the Unlawful Activities (Prevention) Act.

In 2016, Malik along with other Hurriyat leaders had formed a self-styled group called 'Joint Resistance Leadership', whereby they started issuing directions to the masses to hold protests, demonstrations, hartals, shutdowns, road-blocks and other disruptive activities which would push the entire society into chaos and lawlessness.

Malik was also involved in raising funds from LOC traders, and various entities based abroad and distributing those funds among militants and stone-pelters for funding stone-pelting and demonstrations.

He was charge-sheeted for his involvement in the offences under sections 120B, 121, 121A & 124A of IPC and Sections 13, 16, 17, 18, 20, 38 & 39 of UA(P)Act, on April 10, 2019.
